To all Owners of Condominium Units in Renaissance I:
As the Developer of the Renaissance project, we are communicating with you in response to a limited number of inquiries about the building that we have received from residents over the past several months, and to disclose and report to you about our imminent plans to resolve a matter raised by some residents. We have received anecdotal reports of unpleasant odors in some units. Recently, we discovered the likely source of the odor is certain paint applied in some units. Sherwin-Williams, the manufacturer of the paints applied during construction, has advised us that they have conducted extensive testing to identify the cause of the odor in affected units, to determine whether there are potential adverse health effects associated with the odor, and to identify a solution to the problem. Sherwin-Williams has concluded that the breakdown of a raw material no longer used in their interior paints is likely causing the odor. The raw material breaks down under isolated conditions, and the odor occurs when the dried interior paint film is exposed to elevated levels of ozone, high humidity, and warm temperatures. While very minute amounts of the odor-causing compound can produce a strong odor in affected units, testing and analysis has determined that the odor poses no adverse health effects. Testing has confirmed that application of new paint will eliminate the odor. The subject raw material was part of only limited batches of the type of paints applied at the Renaissance during construction. Based on the information we have, we think that this situation exists in only some units. We are hereby soliciting your assistance to identify all units with the paint related odor problem and to correct the problem. Attached is Form A which we are asking that you complete and return as soon as possible to the Concierge Desk. We would very much appreciate that all such Forms A be returned not later than December 13, 2002. All unit owners who respond that odor is or may be an issue in their unit will receive at no expense new paint to be applied by a licensed painting contractor. We are advised by Sherwin-Williams that the new paint comes in a wide variety of colors. The new paint can be colormatched to your current paint color if that is what you desire, or you can select new paint colors for your unit. We want to work with you and your schedule to make this a process which is the least disruptive to your life as possible. This will be accomplished without cost to you. One of our representatives will be contacting those of you who respond indicating on Form A the existence of the paint odor and a desire to correct the problem. We will discuss your particular situation and schedule a time for this work to be done. If you lease your unit, we will also be asking you for assistance in coordinating this process with your tenant. In addition, Sherwin-Williams has agreed to make its technical and health professionals available to meet with unit owners who express a desire to meet with them. They will answer technical or other questions you may have. If you are interested in meeting with the Sherwin-Williams representatives, please check the box on the attached Form B. A SherwinWilliams representative or one of our representatives will contact you to schedule a meeting. We are truly sorry, and apologize to you, for any inconvenience which has to date been incurred or may in the future be incurred by any resident as a consequence of the paint situation and our efforts to complete this interior work.
